I have seen parallel conductors on heater circuits a number of times, but the tub was certified by UL in this configuration. Personally, I am not a fan of parallel circuits, but they can safely serve certain purposes.
This particular case is a different matter. NEC Article 110.3(B) specifically requires electrical equipment to be installed according to the manufacturers instructions. The UL or ETL certification is predicated on the equipment being installed in the recommended manner. The minimum wire size and/or type specified by the manufacturer must be adhered to. This is mandatory (well, at least if we want a safe, code compliant installation).
